FOKUS Beta Terms

These Beta Terms govern access to and use of the prerelease version of FOKUS™ (the “Beta”).
FOKUS is developed, owned and operated by Elias Järvenpää, with the consent of his legal guardians. That consent authorizes operation of the Beta and does not transfer to the guardians any ownership of FOKUS or its intellectual property.

By creating an account, expressly accepting these Beta Terms or using the Beta, you agree to them. If you do not agree, do not use the Beta.
1. Eligibility and access
You must be at least 13 years old to use the Beta. If applicable law requires permission from your parent or legal guardian, you may use the Beta only with that permission.
A waitlist request does not guarantee access. Access is personal, and FOKUS may approve or decline requests, limit the number of users, or place users back on a waitlist.
You must provide accurate account information. You may not sell, share or transfer your account or allow another person to use your login credentials.
2. Nature of the Beta
FOKUS is prerelease study-planning software provided for testing, evaluation and personal study planning. It may contain defects, incomplete features, inaccurate outputs or interruptions. Features, interfaces, algorithms, recommendations, availability and data structures may change during the Beta.
FOKUS may recommend what, when or how to study based on information available to it. Recommendations and readiness estimates are informational only. They are not official school instructions, professional educational advice or guarantees of any academic result.
You remain responsible for:
- checking official examination dates, deadlines and school instructions;
- checking the accuracy of information entered into FOKUS;
- deciding what and how to study; and
- keeping separate copies of information you cannot afford to lose.
FOKUS does not guarantee any grade, examination result, admission outcome, learning outcome or uninterrupted availability.
3. Permission to use FOKUS
Subject to these terms, you receive a limited, personal, revocable, non-exclusive, non-sublicensable and non-transferable permission to access and use the Beta for lawful personal study planning and evaluation.
This permission does not transfer ownership of FOKUS or any part of it to you.
You may not:
- sell, rent, sublicense, redistribute or commercially exploit the Beta or access to it;
- copy, reproduce or distribute substantial parts of FOKUS except as permitted by mandatory law;
- scrape, crawl, index or systematically extract data or content from FOKUS;
- reverse engineer, decompile or disassemble the software except where mandatory law expressly permits it;
- discover, copy or use non-public source code, algorithms, system instructions, database structures or technical documentation;
- use non-public Beta access or materials to reproduce FOKUS or develop a substantially derived competing product;
- bypass access restrictions, rate limits or security controls;
- probe, scan or test vulnerabilities without prior written permission;
- access or attempt to access another person’s account or data;
- introduce malware or interfere with the operation or security of FOKUS;
- use automated means to create accounts or generate excessive requests;
- use FOKUS for unlawful, fraudulent, abusive or harmful activity; or
- assist another person in doing any of the above.
Nothing in these terms restricts a right that cannot lawfully be restricted.
4. Accounts and security
You are responsible for keeping your credentials confidential and for activity through your account, except where the activity results from circumstances for which FOKUS is legally responsible.
Notify FOKUS promptly at beta@studywithfokus.com if you believe your account has been accessed without permission or you discover a security vulnerability.
FOKUS may require a credential reset or temporarily restrict an account where reasonably necessary to protect the Beta, its users or their data.
4A. Free access, trials and paid subscriptions
Paid upgrades are closed during private beta. While the paid-upgrade gate remains closed, beta testers cannot start a trial, enter FOKUS Checkout or be charged by FOKUS.
If paid subscriptions are later enabled with the owner’s approval, the following catalog applies:
- FOKUS Free: €0, with up to two active upcoming exams and the useful study-habit core;
- FOKUS Unbounded Monthly: €5.99 per month;
- FOKUS Unbounded Annual: €39.99 per year; and
- Founding Unbounded Annual: €29.99 per year, available only to an invited account and grandfathered only while that subscription remains continuous.
Displayed paid prices are in EUR and include VAT. Monthly and annual paid intervals provide the same Unbounded features. Stripe Checkout calculates any applicable tax from the billing information supplied. Before paying, Checkout displays the selected interval, recurring price and a required acceptance of the current FOKUS Terms.
Each account may intentionally start one 14-day Unbounded trial without a card. The trial does not create a Stripe subscription, renew, or charge automatically. It returns to Free when it expires unless the user separately chooses and pays for a subscription.
A paid subscription begins only after the user deliberately selects an enabled paid offer, accepts the terms in Stripe Checkout, submits payment, and a signed Stripe event confirms the subscription. It renews at the selected monthly or annual interval until cancelled. Cancellation is available through billing management, takes effect at the end of the paid period, and leaves access active until that date. A pending cancellation may be restored before period end where Stripe permits it.
A failed renewal receives a seven-day access grace period. If payment remains unresolved, the account returns to Free. Refunds and payment disputes may also end Unbounded access. Downgrading never deletes or conceals study data; an account above the Free limit keeps every exam but must select two upcoming exams for active Free planning.
You may exercise any mandatory right of withdrawal, cancellation, refund, price reduction or remedy available under applicable consumer law by contacting beta@studywithfokus.com. Where you expressly request immediate performance during a statutory withdrawal period, applicable law may permit a proportionate charge for service already provided. Nothing in these terms restricts mandatory consumer rights.
FOKUS may change a future renewal price or paid feature only with clear advance notice and where permitted by law. A change does not retroactively alter an already paid period. If you do not accept a change, you may cancel before it takes effect.
5. Ownership and intellectual property
FOKUS and its original components—including its software, source code, object code, selection and arrangement of features, interface, visual design, branding, documentation, original text and non-public technical materials—are owned by Elias Järvenpää or the applicable licensors.
All rights not expressly granted in these terms are reserved. No acceptance of these terms, use of the Beta, guardian consent or provision of feedback transfers ownership of FOKUS or its intellectual property.
“FOKUS” and associated names, logos and visual identifiers may not be used in a way that falsely suggests ownership, endorsement or affiliation.
These terms do not claim exclusive ownership of general ideas, facts, study methods or other subject matter that intellectual-property law does not protect.
6. Non-public Beta materials
If information or a feature is expressly identified as confidential or non-public, you may not publish or disclose it outside the Beta, including by publishing screenshots, until it is made public by FOKUS.
This restriction does not apply to information that you can demonstrate:
- was already lawfully known to you;
- became public without breach of these terms;
- was independently developed without use of non-public Beta materials;
- was lawfully received from another source; or
- must be disclosed by law.
This section does not prevent good-faith reports to FOKUS, a competent authority, a legal adviser, or your parent or guardian.
7. Your content
You retain ownership of information and content you enter into FOKUS, such as subjects, examinations, tasks and study notes (“User Content”).
You grant FOKUS a limited, non-exclusive licence to host, store, copy, process and display User Content only as reasonably necessary to provide, maintain, secure and improve the Beta, comply with law, and perform the processing described in the Privacy Notice.
This licence ends when the relevant User Content is deleted, except where limited continued retention is reasonably necessary for backups, security records or legal compliance.
You confirm that you have the right to submit your User Content and that it does not infringe another person’s rights or contain unlawful material. Do not enter passwords, payment information, health information or other sensitive personal data unless FOKUS expressly requests and supports it.
8. Feedback
Providing feedback is voluntary. If you submit suggestions, ideas, bug reports or other feedback specifically about FOKUS, you grant Elias Järvenpää a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable and royalty-free right to use, reproduce, modify and incorporate that feedback into FOKUS and related products.
You are not entitled to payment, credit or ownership merely because feedback is used. This section does not transfer ownership of your unrelated User Content.
9. Privacy
Personal data is processed as described in the current Privacy Notice, including the identity and contact details of the data controller, purposes and legal bases of processing, recipients, retention periods, international transfers and data-protection rights.
The Privacy Notice is separate from these Beta Terms. Where processing depends on consent, consent may be withdrawn without affecting processing already lawfully performed.
10. Third-party services
FOKUS may rely on or link to services operated by third parties, such as hosting, authentication, email or database providers. Independent third-party services may be governed by their own terms and privacy notices.
FOKUS is not responsible for an independent third-party service merely because the Beta links to or interoperates with it. This does not exclude responsibility that cannot lawfully be excluded.
11. Suspension and termination
You may stop using the Beta and request deletion of your account at any time by emailing beta@studywithfokus.com.
FOKUS may suspend or terminate access where reasonably necessary because:
- you materially or repeatedly breach these terms;
- your use creates a legal, security or operational risk;
- restriction is necessary to protect another user;
- restriction is required by law; or
- the Beta or a relevant part of it is discontinued.
Where reasonably possible, you will receive notice and an opportunity to correct a remediable breach. Access may be restricted immediately where reasonably necessary to prevent harm, unlawful activity, unauthorized access or a security incident.
When access ends, your permission to use the Beta ends. Provisions concerning ownership, feedback, liability and provisions intended by their nature to continue remain effective.
12. Availability, changes and data
FOKUS may modify, suspend or discontinue Beta features. Where reasonably possible, advance notice will be given of material changes or discontinuation.
Reasonable care will be used in operating and securing the Beta, but because it is prerelease software, FOKUS cannot promise that it will always be available or that data will never be lost or corrupted. Do not use FOKUS as the only copy of important information.
Nothing in this section limits a statutory right to retrieve User Content or other data.
13. Liability
The private Beta is currently provided without charge because paid upgrades are closed. If paid access is later enabled, statutory remedies and mandatory consumer protections continue to apply. To the fullest extent permitted by law, FOKUS is not liable for indirect or unforeseeable loss, loss of academic opportunity, or loss caused by reliance on an unverified recommendation, examination date or user-entered information.
Nothing in these terms excludes or limits liability for intentional conduct, gross negligence, fraud, death or personal injury where liability cannot be excluded, breach of mandatory data-protection obligations, or any other liability that Finnish or European Union law does not permit to be excluded.
Nothing in these terms limits mandatory consumer rights.
14. Changes to these terms
These terms may be updated to reflect changes to the Beta, law, security requirements or operating practices.
Material changes will be explained and presented before they apply to continued use. Renewed acceptance will be requested where required. Changes urgently required for legal or security reasons may take effect sooner, in which case notice will be provided as soon as reasonably possible.
If you do not accept a material change, you may stop using the Beta and request deletion of your account.
15. Applicable law and disputes
These terms are governed by Finnish law, without depriving a consumer of mandatory protections available under the law of their country of residence.
Please contact beta@studywithfokus.com first so that the matter can be investigated and an attempt made to resolve it.
If you are a consumer, you may bring proceedings in any court available under mandatory consumer law. These terms do not require a consumer to use a court or dispute procedure that mandatory law does not permit.
16. General provisions
If a provision is found unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
Failure to enforce a provision immediately does not waive the right to enforce it later.
You may not transfer your rights or obligations under these terms without prior written permission. Operation of FOKUS and these terms may later be transferred to a company established for FOKUS or as part of a legitimate reorganization, financing or transfer of the service, provided mandatory rights are not reduced and notice is given where required by law. Such a transfer does not by itself transfer Elias Järvenpää’s intellectual property unless an express written transfer is separately made.
These Beta Terms, the Privacy Notice and any expressly incorporated Beta rules constitute the agreement concerning use of the Beta.
